TERMS & CONDITIONS

Please read and understand these Terms & Conditions carefully before renting a vehicle from Shah Alam Car Rental.
Sila baca dan fahami Terma & Syarat ini dengan teliti sebelum menyewa kenderaan daripada Shah Alam Car Rental.

By making a booking, collecting a vehicle, or entering into a rental agreement with us, the Hirer acknowledges and agrees to comply with the following Terms & Conditions.
Dengan membuat tempahan, mengambil kenderaan, atau memasuki perjanjian sewaan dengan kami, Penyewa mengakui dan bersetuju untuk mematuhi Terma & Syarat berikut.

1. DRIVER REQUIREMENTS

The driver must be between 20 and 65 years old and must possess a valid identification document (MyKad/Passport) and a valid driving licence.
Pemandu mestilah berumur antara 20 hingga 65 tahun dan mempunyai dokumen pengenalan diri yang sah (MyKad/Pasport) serta lesen memandu yang sah.

We reserve the right to obtain and retain copies of these documents for verification and record-keeping purposes.
Kami berhak untuk mendapatkan dan menyimpan salinan dokumen ini untuk tujuan pengesahan dan rekod.

The Hirer is responsible for ensuring that only authorised and properly licensed drivers operate the vehicle during the rental period.
Penyewa bertanggungjawab memastikan hanya pemandu yang dibenarkan dan mempunyai lesen yang sah memandu kenderaan sepanjang tempoh sewaan.

2. USE OF THE VEHICLE

The Hirer is fully responsible for the proper and lawful use of the vehicle throughout the rental period.
Penyewa bertanggungjawab sepenuhnya terhadap penggunaan kenderaan secara betul dan sah sepanjang tempoh sewaan.

The vehicle must not be used for any illegal activity, criminal activity, unlawful purpose, or in any manner that violates the laws and regulations of Malaysia.
Kenderaan tidak boleh digunakan untuk sebarang aktiviti haram, jenayah, tujuan yang menyalahi undang-undang, atau melanggar undang-undang Malaysia.

Any consequences, losses, damages, penalties, or liabilities arising from the misuse or unlawful use of the vehicle shall be the responsibility of the Hirer.
Sebarang akibat, kerugian, kerosakan, penalti atau liabiliti akibat penyalahgunaan kenderaan adalah tanggungjawab Penyewa.

3. MILEAGE LIMIT

The standard mileage limit is:
Had perbatuan standard adalah:

300 km per day; or
300 km sehari; atau
5,000 km per month.
5,000 km sebulan.

Any mileage exceeding the applicable limit may be subject to additional charges based on the applicable daily or monthly rental rate.
Sebarang lebihan perbatuan akan dikenakan caj tambahan berdasarkan kadar sewaan harian atau bulanan yang berkenaan.

4. VEHICLE INSPECTION UPON COLLECTION

The Hirer must inspect the vehicle upon collection and before taking possession of it.
Penyewa mesti memeriksa kenderaan semasa pengambilan sebelum mengambilnya.

The Hirer should check the vehicle for any existing damage, scratches, dents, missing parts, accessories, or other defects.
Penyewa perlu memeriksa sebarang kerosakan, calar, kemek, bahagian hilang, aksesori atau kecacatan lain.

Any existing damage or missing items must be reported to our staff before the vehicle is driven away.
Sebarang kerosakan atau item hilang mesti dilaporkan kepada staf kami sebelum kenderaan dipandu keluar.

Any damage or missing item discovered upon return that was not reported during vehicle collection may be considered the responsibility of the Hirer.
Sebarang kerosakan atau item hilang yang ditemui semasa pemulangan tetapi tidak dilaporkan semasa pengambilan boleh dianggap tanggungjawab Penyewa.

5. VEHICLE DAMAGE & INSURANCE EXCESS

In the event that the vehicle is damaged during the rental period, the Hirer may be responsible for the applicable repair costs.
Jika kenderaan rosak semasa tempoh sewaan, Penyewa mungkin bertanggungjawab terhadap kos pembaikan.

Where a claim is made under the vehicle’s insurance policy, the Hirer will be responsible for paying the applicable insurance excess, subject to the terms, conditions, exclusions, and approval of the relevant insurance policy.
Jika tuntutan dibuat di bawah polisi insurans, Penyewa bertanggungjawab membayar caj excess, tertakluk kepada terma, syarat, pengecualian dan kelulusan polisi insurans.

Group A

Standard Excess: RM4,000
Caj Excess Biasa: RM4,000
With Optional Excess Protection: RM2,000
Dengan Perlindungan Caj Excess: RM2,000

Group B

Standard Excess: RM6,000
Caj Excess Biasa: RM6,000
With Optional Excess Protection: RM3,000
Dengan Perlindungan Caj Excess: RM3,000

Group C

Standard Excess: RM10,000
Caj Excess Biasa: RM10,000
With Optional Excess Protection: RM5,000
Dengan Perlindungan Caj Excess: RM5,000

Group D

Standard Excess: RM20,000
Caj Excess Biasa: RM20,000
With Optional Excess Protection: RM10,000
Dengan Perlindungan Caj Excess: RM10,000

The applicable insurance excess may be reduced by 50% if the Hirer purchases our Optional Excess Protection.
Caj excess insurans boleh dikurangkan sebanyak 50% jika Penyewa membeli Perlindungan Caj Excess

Optional Excess Protection is charged at an additional 10% of the rental charge.
Perlindungan ini dikenakan caj tambahan sebanyak 10% daripada caj sewaan.

Optional Excess Protection reduces the applicable excess only. It does not eliminate the Hirer’s responsibility and remains subject to the exclusions stated in these Terms & Conditions.
Perlindungan ini hanya mengurangkan lebihan dan tidak menghapuskan tanggungjawab Penyewa serta tertakluk kepada pengecualian dalam Terma & Syarat ini.

6. INSURANCE & EXCESS PROTECTION EXCLUSIONS

Insurance and Optional Excess Protection may not apply to damage, loss, or liability resulting from:
Insurans dan Perlindungan Caj Excess mungkin tidak terpakai bagi kerosakan, kehilangan atau liabiliti akibat:

Reckless, careless, or negligent driving;
Pemanduan berbahaya, cuai atau lalai;
Illegal activities;
Aktiviti haram;
Improper or unauthorised use of the vehicle;
Penggunaan kenderaan yang tidak dibenarkan;
Deliberate damage;
Kerosakan yang disengajakan;
Driving under circumstances prohibited by the rental agreement;
Pemanduan dalam keadaan yang dilarang oleh perjanjian;
Tyre punctures or burst tyres;
Tayar pancit atau pecah;
Incorrect refuelling;
Pengisian bahan api yang salah;
Battery damage caused by improper use of the vehicle’s electrical equipment; or
Kerosakan bateri akibat penggunaan peralatan elektrik yang tidak betul; atau
Loss of or damage to vehicle accessories, equipment, or other items supplied with the vehicle.
Kehilangan atau kerosakan aksesori, peralatan atau item lain yang disediakan bersama kenderaan.

Where insurance or Optional Excess Protection does not apply, the Hirer may be responsible for the applicable loss, damage, repair, replacement, recovery, or related costs.
Jika insurans tidak digunapakai, Penyewa bertanggungjawab terhadap kos kerugian, kerosakan, pembaikan atau penggantian.

7. ACCIDENTS INVOLVING THIRD PARTIES

If the vehicle is involved in an accident with another vehicle or third party, the Hirer must obtain as much relevant information as reasonably possible, including:
Jika berlaku kemalangan dengan pihak ketiga, Penyewa mesti mendapatkan maklumat seperti:

Full name of the third-party driver;
Nama penuh pemandu pihak ketiga;
MyKad/Passport details;
Butiran MyKad/Pasport;
Driving licence details;
Butiran lesen memandu;
Vehicle registration number;
Nombor pendaftaran kenderaan;
Contact details; and
Maklumat hubungan; dan
Any other information reasonably required for an insurance claim.
Maklumat lain yang diperlukan.

The Hirer should also take photographs of the accident scene, vehicles involved, and any visible damage where it is safe to do so.
Penyewa juga perlu mengambil gambar tempat kejadian jika selamat.

If a claim cannot be successfully made against the third party or the third party’s insurer, the Hirer is responsible for the damage, subject to the applicable insurance excess, Optional Excess Protection, insurance policy, and these Terms & Conditions.
Jika tuntutan gagal, Penyewa bertanggungjawab terhadap kerosakan.

8. WINDSCREEN DAMAGE

Any damage to the windscreen during the rental period must be reported to us immediately.
Sebarang kerosakan cermin hadapan mesti dilaporkan segera.

The Hirer may be required to pay the applicable windscreen insurance premium, protection charge, excess, repair cost, or replacement cost.
Penyewa mungkin perlu membayar premium insurans, caj perlindungan, lebihan atau kos pembaikan.

9. ACCIDENTS, THEFT & LOSS

The Hirer must contact our representative immediately in the event of:
Penyewa mesti menghubungi kami segera jika berlaku:

Accident;
Kemalangan;
Theft or attempted theft;
Kecurian;
Loss of the vehicle;
Kehilangan kenderaan;
Significant damage; or
Kerosakan besar;
Any serious incident.
Sebarang insiden serius.

A police report must be made within 24 hours.
Laporan polis mesti dibuat dalam 24 jam.

Failure to report may affect insurance coverage.
Kegagalan melapor boleh menjejaskan insurans.

10. BOOKING CANCELLATION

Cancellation must be made at least 7 days before the booking date.
Pembatalan mesti dibuat sekurang-kurangnya 7 hari sebelum tarikh tempahan.

Deposits may be forfeited if late cancellation occurs.
Deposit dikira hangus jika membuat pembatalan tempahan lewat.

11. RENTAL EXTENSION

Extension requests must be made before the rental ends.
Permohonan lanjutan mesti dibuat sebelum tempoh tamat.

Subject to approval and availability.
Tertakluk kepada kelulusan dan ketersediaan.

12. TERMINATION OF RENTAL

We may terminate the agreement if the Hirer breaches any terms.
Kami boleh menamatkan perjanjian jika berlaku pelanggaran terma.

13. EARLY RETURN / EARLY TERMINATION

No refund for unused days unless agreed.
Tiada bayaran balik untuk hari tidak digunakan kecuali dipersetujui.

14. VEHICLE RETURN, CLEANING, SMOKING & PETS

Vehicle must be returned in good condition.
Kenderaan mesti dipulangkan dalam keadaan baik.

Smoking is strictly prohibited.
Merokok adalah dilarang.

Pets not allowed without approval.
Haiwan peliharaan tidak dibenarkan tanpa kebenaran.

Cleaning fee up to RM500 may apply.
Caj pembersihan sehingga RM500 boleh dikenakan.

15. TRAFFIC & PARKING SUMMONS

Hirer is responsible for all summonses.
Penyewa bertanggungjawab terhadap semua saman.

RM300 penalty may apply for late payment.
Denda RM300 boleh dikenakan jika penyewa lewat membuat bayaran saman.

16. SECURITY DEPOSIT

Refund within 7–14 working days subject to checks.
Pemulangan dalam 7–14 hari bekerja tertakluk kepada semakan.

Deductions may apply for outstanding charges.
Potongan boleh dibuat untuk caj tertunggak.

VEHICLE GROUP CLASSIFICATION

Group A: Economy cars – Kereta ekonomi

Group B: MPV/SUV economy – MPV/SUV ekonomi

Group C: Sedan/SUV – Sedan/SUV

Group D: Premium vehicles – Kenderaan premium

ACKNOWLEDGEMENT

By accepting the vehicle, the Hirer agrees to all terms.
Dengan menerima kenderaan, Penyewa bersetuju dengan semua terma.
